WELCOME TO POCKETSCHOOL PTY LTD ("COMPANY") BEFORE YOU USE OUR SERVICE, YOU MUST READ THESE TERMS AND CONDITIONS ("TERMS") CAREFULLY.
BY USING OUR SERVICE, YOU AGREE TO THESE TERMS AND CONDITIONS; IF YOU DO NOT AGREE; DO NOT USE THE SERVICE.

In this Agreement, "you" and "your" refer to each customer and his or her agents, and "we", "us" and "our" refer collectively to PocketSchool. This Agreement explains our obligations to you, and your obligations to us in relation to the PocketSchool Service.
The Service provided is the delivery of Multimedia Messaging Service (MMS) messages consisting of text and audio as well as from time to time a Short Message Service (SMS) message.

To use this service you must have a MMS compatible handset and this service must be activated with your phone carrier. Most phones will have this available and if you have a colour phone that can send and receive 'Picture' messages then this will be suitable. For a list of MMS compatible handsets go to www.gsmarena.com. If you are unsure of whether or not your phone supports the service please send an SMS with "test" to 0429 982 327.

This product is not for commercial use, it is only for your personal purpose and you may not distribute the messages beyond your own phone. You agree that this property is protected by intellectual property laws. Company hereby grants, and you hereby accept, a limited, non-exclusive, non-transferable, revocable license to download and use the Download(s) and the Service on a designated compatible mobile device solely for your own personal non-commercial use. You further acknowledge and agree that you may not reproduce, modify, perform, transfer, distribute, sell, create derivative works of or otherwise use or make available the Download(s) except as expressly provided in this Agreement.

The product relies on third parties for delivery and as such we can not guarantee delivery of the messages.

Your telecommunications provider may levy you with additional charges for using this service and we do not accept liability for any additional charges.

Payment for the service is via credit card and to pay for this service you must be over 16 years of age or have permission of the card holder to pay for the service.

Company reserves the right at any time and from time to time to modify, suspend, discontinue or permanently cancel the Service, or portions thereof, with or without notice to you. If the Service, or any part thereof, for which you subscribe is permanently discontinued or canceled by Company we will cancel your subscription and reimburse any pre-paid fees related to such Service.

While all care has been taken to ensure accurate translations in this course we do not accept liability for losses you incur by relying on the content of this course. You understand and agree that your use of the service is solely at your own risk and that you will be solely responsible for any damage to your mobile device or loss of data that may result from your use. You acknowledge and agree that company shall have no liability to you, or to any third party, for any modification, suspension, discontinuance or termination of the service. Company makes no warranties that the service will meet your requirements, or that the service will be uninterrupted, timely, secure or error free. No advice or information, whether oral or written, obtained by you from us or through our services shall create any warranty not expressly made herein. You agree that company's entire liability to you or any third person, and your or any third person's exclusive remedy, in law, in equity, or otherwise, with respect to the service provided under this agreement and/or for any breach of this agreement is solely limited to the amount you paid for such services during the term of this agreement. Company shall not be liable for any indirect, incidental, special or consequential damages.
Company will store reasonable information on you and your usage of the Service for the purpose of providing the Service.

Company reserves the right to contact you from time to time while you are a subscriber of the service either via Email or SMS to inform you of the status of your service or of additional features you may benefit from.

This contract is governed by and construed in accordance with the laws of New South Wales (Australia) and the Parties submit to the jurisdiction of the courts of New South Wales.

This Agreement is subject to change from time to time, as each payment is made in relation to a section of the course. The current terms will be posted on this website if changed.
